Terms and Conditions of Sale
The sale of products on the website https://yoga-nest.com/shop/ (hereinafter referred to as the “Site”) is governed by these Terms and Conditions of Sale. The customer is required, before submitting their order, to carefully read these Terms and Conditions of Sale. Submitting the order implies full knowledge and express acceptance of the aforementioned Terms and Conditions of Sale, as well as the information contained in the Order Form. Once the online purchase procedure is completed, the customer is required to print and keep these Terms and Conditions of Sale and the respective Order Form, which have already been read and accepted.
- Purpose
- 1.1 The purpose of these Terms and Conditions of Sale is the online sale of products via e-commerce services on the site to customers (hereinafter referred to as the “Customer”) domiciled, headquartered, or habitually residing in Switzerland, Liechtenstein, France (metropolitan, Andorra, and Monaco), Germany, or Austria.
- 1.2 Products can only be purchased and delivered within the mentioned territories. For delivery elsewhere, the Customer must contact the Seller for a specific cost estimate.
- 1.3 Any order implies acceptance of these GTCs, the validation of the order constituting an electronic signature with equivalent legal value.
- 1.4 These GTCs are available at all times on the site and supersede any contradictory document.

- 2.3 The Customer is identified by the data entered in the electronic Order Form.
- 2.4 Products are intended for adult customers with legal capacity. If this is not the case, parental consent is required.
- 2.5 It is forbidden to use false data. The Seller reserves the right to take action in case of misuse.
- 2.6 The Customer is responsible for the accuracy of the tax data entered.

- 3.8 Orders are placed via an electronic form.
- 3.9 The Order includes: Reference to GTCs, Product details & price, Payment methods, Delivery terms & costs.
- 3.10 Acceptance of the GTCs is required to finalize the Order.
- 3.11 A confirmation of receipt is sent by email.
- 3.12 Once verified, the order is validated & the Customer is notified by email.
- 3.13 The sales contract is formed after validation.
- 3.14 The Seller is only responsible for technical means, not for the hazards of the Internet network.
- Order Placement
- 4.1 The Seller may request additional information before preparation.
- 4.2 The Seller may refuse an unreliable order. The Customer will be informed.
- 4.3 In case of unavailability, the Customer will be informed within 15 days. The rest of the order remains valid.
- 4.4 Orders must correspond to normal consumption.
- 4.5 The Seller may refuse an order if a prior dispute exists.
- 4.6 In case of cancellation by the Customer or refusal for a legitimate reason, a partial refund will be issued, after deduction of processing fees (CHF 5–10) & bank commissions.
- Selling Price
- 5.1 Displayed prices include Swiss VAT and are expressed in CHF. Prices are subject to change without notice.
- 5.2 Shipping costs are extra, depending on weight, destination & delivery method. Customs duties and taxes outside Switzerland & Liechtenstein are not included.
- 5.3 In case of a pricing error, the Seller will contact the Customer. If the price is too low, the order may be canceled. If the correct price is lower, the Customer will be charged the lower price.
- Payment Methods
To pay for the Products and shipping costs, the Customer may use one of the following methods:- 6.1 Credit and Debit Cards (including Postcard)
- 6.1.1 Payment without additional fees. The cardholder must match the billing name.
- 6.1.2 The amount is automatically debited upon order confirmation.
- 6.2 PayPal
- Payment via the email address and password of the www.paypal.com account.
- 6.3 Twint
- Payment via the Twint app offered by the Customer’s bank.
- 6.4 Cash Payment
- Only available for Click & Collect in Geneva. The exact amount must be presented in CHF.
- 6.5 Payment by Invoice
- Only available for:
- For orders CHF 200.
- Deliverable in Switzerland
- For residents of Switzerland
- Invoice payable within 7 days. Credit check possible. IBAN or QR code provided in the package.
- 6.6 Bank Transfer
- Payment within 7 days, mentioning the order number as payment reference. After this period, the order will be canceled. International transfer fees are the responsibility of the Customer; payment must be in CHF. The order will be shipped upon full receipt of payment.
- 6.7 Payment Data Protection
- YOGANEST does not store any banking data. All information is processed via secure platforms (banks, PayPal).
- 6.8 Liability
- YOGANEST cannot be held responsible in case of fraudulent use by third parties.
- 6.9 Confirmation
- The order is considered effective only after full payment validation.
- 6.10 Retention of Title
- Products remain the property of YOGANEST until full payment. The Seller’s responsibility ceases as soon as the order is handed over to the carrier.

- No express delivery. No plastic. Packaging reused whenever possible.
- 7.2 Delivery Times
- Delivery within a maximum of 30 days. In the case of specific productions with long lead times, the Customer will be informed.
- 7.3 Customs Duties
- Applicable for deliveries outside Switzerland Liechtenstein. The Customer is responsible for any potential fees, taxes, and customs or import formalities. To learn about these, it is the Customer’s responsibility to inquire with the competent authorities in their country.

- 7.5.2 Address Accuracy
- Purchased Products will be delivered by the courier service designated by the Seller to the delivery address indicated by the Customer on the Order. The buyer must ensure that their contact details are correct and complete.
- 7.5.3 Package Verification upon Receipt
- The Customer must thoroughly check, upon receipt of the goods at the indicated delivery address, that the package is complete. In case of any anomaly, the Customer must have it noted and accurately recorded by the courier service and must refuse the package. Otherwise, they will no longer be able to assert their rights in this regard.
- 7.5.4 Returns if not collected
- If the Customer or the recipient of the ordered package is absent at the time of delivery, they will receive a delivery notice, and it is their sole responsibility to arrange for the collection of the package from the delivery provider within the allotted time, regardless of the country of destination. If the Customer is unable to collect their package, it will be returned to the Seller, who will then offer to reship the order to the Customer a second time at the cost of a new shipment, payable by the Customer. In this case, the Seller reserves the right to charge the Customer for any return shipping fees, particularly if the package was returned from a country other than Switzerland. If the Customer does not wish to have the order redelivered, they will be refunded the value of the Order, after deducting the initial shipping costs, incurred return fees, and a twenty (20) Swiss Francs fee retained by the Seller for return processing. No dispute regarding the delivery itself is possible if the package appears to have been delivered, with the IT system of the carrier or La Poste serving as proof.
- 7.5.5 Delays, Force Majeure
- YOGANEST is a small operation and does not commit to immediate order processing. If delivery times are provided, they are for informational and indicative purposes only, as they depend notably on the availability of carriers and the order in which Orders are received. The same applies in cases of forced closure of the Seller’s company, force majeure, or circumstances beyond its control, such as strikes, frost, fire, storm, flood, epidemic, supply difficulties, without this list being exhaustive. Delivery delays cannot give rise to any penalty or compensation, nor justify the cancellation of the Order.
- 7.5.6 Split Shipments
- The Seller reserves the right to split shipments, for example, in case of temporary unavailability of certain Products or in case of direct delivery of certain items by the original brands.

- 8.1 A Responsible Approach
- In contrast to fast fashion, the Seller encourages fair and responsible consumption. Our wish is for you to wear what you order, and since every shipment has a carbon footprint, even if it’s small, we want to work with you to reduce it.
- 8.2 Return Conditions
- If a return is necessary, the Customer must first contact Customer Service, specifying the reason for the return. The Seller accepts returns within 14 days from the shipping date, provided that the Products:
- have not been used, worn, stained (be careful with deodorant and makeup),
- have not been altered or washed,
- are returned in their original packaging with original labeling.
- Returns can be made in Geneva, by appointment only (as for Click Collect – see point 7.6) or sent back via tracked postal service, at the Customer’s expense.

- If a return is necessary, the Customer must first contact Customer Service, specifying the reason for the return. The Seller accepts returns within 14 days from the shipping date, provided that the Products:
- 8.3 Exceptions and Refunds
- Cosmetic items and books cannot be returned or exchanged, as well as all sale items or promotional offers.
- Returned products will be checked upon receipt. The Seller reserves the right to refuse a refund if the items are altered.
- If accepted, the refund will be issued within a maximum of 20 days, by crediting the payment method used for the initial Order, and will only cover the price of the returned Products.
- 8.4 Exchange
- If the Customer opts for an exchange, the Seller will cover (once) the shipping costs for the second shipment, as a commercial gesture.
- If the Customer chooses to pick up the exchange via Click Collect, no financial compensation will be granted for this offer.
- 8.1 A Responsible Approach
- Legal Guarantee of Conformity
Upon delivery, the Customer must inspect the products to ensure they match the ordered items and have no defects of conformity. The sale of Products is subject to the legal guarantees provided by the current law (articles 210 of the CO). All products sold by the Seller are covered by the legal guarantee against defects of conformity for two (2) years from the time of goods delivery: this means that the Seller is responsible when the defect of conformity appears within this period. Only Products with a proven hidden defect may be returned under this reason. The Customer who declares that their product suffers from a hidden defect must provide proof. Upon receipt of the document, the Seller will send the Customer a written confirmation, as well as the procedure to follow and the return address for sending the Product to Customer Service. The return costs of the Product are borne by the Customer. Acceptance of the return will be made after the Seller has confirmed the hidden defect. Once the return is accepted, the Product will be exchanged at the Seller’s expense. - 10.1 These Terms and Conditions of Sale, and consequently their interpretation, execution, and termination, as well as all transactions concluded in relation thereto, are governed exclusively by Swiss law.

- 11.5 The Seller will process the personal data that the Customer provides when ordering Products for the execution of their Orders and for related activities (sending Order Receipt Confirmation, shipping goods, invoicing, payment management, and associated activities, etc.). Should the Seller intend to use the data provided by the Customer when ordering Products for purposes other than the provision of the requested service or for additional purposes, the Seller will request the Customer’s consent before proceeding with data processing.
- 11.6 The Seller may transmit the Customer’s personal data to third parties external to its company to the extent necessary and useful to achieve the purpose of data processing based on the service the Customer has chosen. In particular, the Seller may send this data to parcel delivery companies, companies that perform postal or correspondence sending services, financial institutions such as PayPal. Furthermore, it may transmit the Customer’s personal data to third parties if it deems it necessary to comply with applicable laws and regulations, in case of legal proceedings, at the request of courts and competent authorities, or under other legal obligations to protect and defend its rights and/or assets.
- 11.7 The Seller is careful to use IT tools and data carriers, technical and organizational instruments capable of guaranteeing the security and confidentiality, as well as the accuracy, updating, and relevance of the Customer’s personal data. However, it reminds the Customer that data transmission via the internet or other electronic means presents inherent and unavoidable risks and that, consequently, despite its IT and technical systems, it cannot guarantee the absolute security of the data that the Customer transmits to it via these means.
- 11.8 The Customer may exercise the rights recognized by law at any time. In particular, they have the right to obtain confirmation of the existence or non-existence of the data provided (content and origin), to verify its accuracy, or to request that it be completed, updated, rectified, and/or deleted.
- 11.9 If the Customer has questions, wishes to request information, or exercise the rights provided in section 11.8, they may send an email to [email protected] or contact the data controller at the address indicated in section 11.2.
- Intellectual Property
- 12.1 All elements of the site https://yoga-nest.com/e-shop/ (images, logos, texts, videos, comments, graphic charter, etc.) are the exclusive intellectual property of the Seller or the partner brands it distributes. Any other use constitutes infringement and is punishable under Intellectual Property law, unless prior authorization is obtained from the Seller. All rights reserved.
- 12.2 No Customer or visitor to the Site may create a hyperlink to it without the Seller’s prior authorization. The Seller cannot be held responsible for access by the Customer or a visitor via hyperlinks established on the Site leading to other resources present on the internet network.
- Modification and Update
The Seller may make modifications and amendments to these Terms and Conditions of Sale at any time. Therefore, the Customer shall only accept the Terms and Conditions of Sale in force at the time of the relevant Order. The new Terms and Conditions of Sale will apply from the date of publication on the website https://yoga-nest.com/e-shop/ and to Orders placed from that date. - Translations
